Benfleet resident successfully prosecuted for noise disturbance

The Environmental Health team at Castle Point Borough Council has successfully prosecuted a Benfleet resident for failure to comply with an abatement notice.
The resident repeatedly played loud music and disturbed a number of their neighbours. After a thorough investigation, an abatement notice was served under the Environmental Protection Act 1990 requiring him to abate the nuisance and stop it from happening again. The notice was not complied with and so the team applied for a warrant which was carried out with the support of the local policing team, where all equipment believed to be contributing to the nuisance was seized.
The case against the subject was concluded on 17 April 2025 at Southend Magistrates Court where, despite a plea of not guilty, he was found guilty on all counts brought against him. The subject has been ordered to pay a fine, a victim surcharge and a contribution towards the Council’s costs. He will also have a criminal record for six months. Environmental Health were awarded a deprivation order for the equipment seized and will now arrange for it to be destroyed.
